When we prepare a disability appeal, the first thing we do is ask for a copy of your insurance policy to determine what your rights and responsibilities are in terms of proving your case. We also request a full copy of your claims file, then I take that claims file, pull it apart and reverse engineer it to determine what medical evidence we need to provide to the insurance company. That way, we will be able to work with you to establish and obtain updated medical records and, perhaps, forms or letters from your doctors to address the reasons stated in the denial letter that the insurance company denied it – your request. If you see more than one doctor, we will try to get a statement from each. Here is an overview of our appeal preparation process:
We also work with you to get your statement, usually in the form of an affidavit or what we call an affidavit. In the statement, we determine what your impairments are and the resulting limitations. The affidavit is additional evidence that we can submit with your disability claim to show the insurance company why you cannot do your job and new evidence that may change the insurance company’s mind.
Finally, we do a comprehensive legal analysis, where we take the reasons that the insurance company rejected your claim, which should be stated in the rejection letter, and show why those reasons are not legally insufficient. We can set up legal cases to compare your claim with others where insurance companies may have made similar mistakes in the past.
